
Pool 22 – Terms and Conditions
1. Definitions
“Pool 22” refers to Pool 22 Ltd, based at 22 Limes Road, Farnborough, Hampshire, GU14 9TS.
“Customer” refers to the person who makes the booking and payment to Pool 22 Ltd. Where a child participates, the Customer must be the child's parent or legal guardian, or an adult authorised by the parent or legal guardian.
“Pool 22 – Important Information & Rules” refers to the separate document of the same name, which forms part of these Terms and Conditions.
By making a booking, the Customer confirms that they have read, understood and agree to these Terms and Conditions and the Pool 22 – Important Information & Rules.
2. Bookings & Payment
All pool hire sessions must be paid for in full in advance.
Bookings are not confirmed until the booking process has been completed, payment has been received and a booking confirmation has been issued by Pool 22.
Fees are non-refundable and non-transferable except where expressly stated in these Terms and Conditions.
Pool 22 reserves the right to refuse or cancel a booking where incorrect, misleading or incomplete information has been provided.
3. Illness & Fitness to Swim
Participants must not attend the pool if they are suffering from sickness, diarrhoea, fever, a contagious illness, skin infection, conjunctivitis, open wounds or any other condition that could pose a health or hygiene risk to themselves or others.
Following sickness or diarrhoea, participants must remain symptom-free for a minimum of 48 hours before returning to the pool.
The Customer must inform Pool 22 before attending of any medical condition, allergy, disability or additional need that may reasonably affect safe participation or require additional consideration.
Pool 22 reserves the right to refuse participation where there are reasonable health, hygiene or safety concerns.
4. Swim Nappies & Pool Hygiene
All babies and children who are not fully toilet trained must wear a double-layer swim nappy system, consisting of a disposable swim nappy and a suitable neoprene over-nappy.
All swimmers, except babies, must wear a swim hat, either their own or one provided by Pool 22.
All swimmers, except babies, must shower and rinse their body before entering the pool.
In the event of a faecal accident or other contamination, the pool may need to be closed immediately for cleaning, treatment and sanitisation. Any affected session may have to end early and no refund or replacement session will be provided where the contamination was caused by a participant within that booking.
5. Cancellations, Rescheduling & Missed Sessions
Customers wishing to rearrange a booking must provide Pool 22 with at least 7 days' notice.
Where sufficient notice is provided, Pool 22 may allow the booking to be moved once, subject to availability. Rescheduled sessions cannot subsequently be rearranged again.
Cancellations, missed sessions and requests to rearrange made with less than 7 days' notice are non-refundable and are not normally eligible for a replacement session.
Pool 22 may, at its discretion, offer an alternative session in exceptional circumstances, but this is not guaranteed and does not create an entitlement to future rescheduling.
If Pool 22 has to cancel a session, the Customer will be notified as soon as reasonably possible and will be offered a replacement session or, where a suitable replacement cannot be provided, a refund for the affected session.
6. Arrival, Punctuality & Departure
Customers should arrive no more than 15 minutes before their scheduled session and must leave the premises promptly following their booking.
Customers are responsible for allowing sufficient time for changing so that the pool is vacated by the end of the booked period.
Late arrival does not extend the booked session. No refund or additional pool time will be provided as a result of late arrival.
Pool 22 reserves the right to refuse entry where a late arrival would create a safety, operational or scheduling issue.
7. Spectators & Guests
Unless otherwise agreed with Pool 22, the Customer may bring a maximum of one spectator to observe from the designated spectator area.
The Customer is responsible for ensuring that everyone attending as part of their booking complies with these Terms and Conditions and the Pool 22 – Important Information & Rules.
Children must remain appropriately supervised at all times.
8. Behaviour & Safeguarding
Pool 22 operates a zero-tolerance policy towards aggressive, abusive, threatening, inappropriate or unsafe behaviour.
Customers and their guests must follow reasonable safety and operational instructions given by Pool 22.
Failure to comply with Pool 22 rules, health and safety requirements or safeguarding standards may result in the session being terminated and the Customer and/or their guests being required to leave the premises.
No refund or replacement session will be provided where a session is terminated due to the behaviour or actions of the Customer or their guests.
9. Photography & Video Recording
Private Pool Hire customers wishing to take photographs or make video recordings is permitted but only in the pool area.
Photography or recording outside the pool area is not permitted.
Pool 22 reserves the right to prohibit photography or recording where necessary for privacy, safeguarding or safety reasons.
10. Health & Safety
Customers and all participants must comply with Pool 22's health and safety requirements and any reasonable safety instructions provided by Pool 22.
The Customer is responsible for ensuring that the activities undertaken during a private hire session are appropriate for the age, swimming ability and circumstances of all participants.
Running, diving or other unsafe behaviour is not permitted unless expressly authorised by Pool 22.
11. Private Pool Hire
Where the pool is hired without an instructor or lifeguard, the Customer accepts responsibility for the direct supervision of all participants included within their booking, including children.
Pool 22 does not provide lifeguard supervision during private pool hire unless this has been expressly agreed in writing.
Children must be continuously supervised by a responsible adult and must never be left unattended in or around the pool.
Customers must not undertake activities beyond their swimming ability and must follow all safety information provided by Pool 22.
An emergency call button is located on the wall opposite the pool ladder and must be used immediately if assistance is required.
The Customer must also use the emergency contact number provided in the booking confirmation if assistance is required.
In a life-threatening emergency, 999 must be called immediately.
12. Damage to Property
The Customer is responsible for any damage caused to Pool 22 premises, pool equipment or other property by themselves, their children or their guests, other than reasonable wear and tear.
Pool 22 reserves the right to recover reasonable repair, cleaning or replacement costs resulting from such damage.
Any damage or breakage must be reported to Pool 22 as soon as possible.
13. Personal Belongings
Customers are responsible for their own personal belongings while on Pool 22 premises.
Pool 22 accepts no responsibility for loss of or damage to personal belongings except where such loss or damage results from Pool 22's negligence or where liability cannot otherwise lawfully be excluded.
14. Liability
Swimming and water-based activities involve inherent risks, and Customers are responsible for following all safety instructions and ensuring that activities are appropriate for the abilities of participants within their booking.
Pool 22 will take reasonable care to provide a safe and properly maintained environment.
Nothing in these Terms and Conditions excludes or limits Pool 22's liability where it would be unlawful to do so, including liability for death or personal injury caused by Pool 22's negligence, fraud or fraudulent misrepresentation.
Pool 22 will not be responsible for loss, damage or injury resulting from a Customer's failure to follow these Terms and Conditions, the Pool 22 – Important Information & Rules, reasonable safety instructions, or from activities undertaken beyond a participant's ability, except to the extent that Pool 22 is legally responsible.
15. Data Protection & Privacy
Pool 22 collects and processes personal information where reasonably necessary to administer bookings, communicate with Customers, provide its services, maintain safety and comply with legal obligations.
Personal information will be handled in accordance with applicable UK data protection legislation and Pool 22's Privacy Policy.
Customers may contact Pool 22 regarding their personal information or their data protection rights using the contact details provided on the Pool 22 website.
16. CCTV
CCTV is in operation on Pool 22 premises for security, safety and crime-prevention purposes.
CCTV recordings are normally retained for up to 30 days, unless they are required for the investigation of an incident, insurance matter, legal requirement or other legitimate purpose.
CCTV is operated in accordance with applicable UK data protection legislation.
17. Events Beyond Our Reasonable Control
Pool 22 will not be responsible for failure or delay in providing a booked session where this results from circumstances beyond its reasonable control, including severe weather, power or utility failure, equipment breakdown, emergency closure, government action or public health restrictions.
Where reasonably possible, Pool 22 will notify affected Customers and seek to offer an alternative session.
18. Changes to These Terms
Pool 22 may update these Terms and Conditions from time to time to reflect changes to its services, operating procedures or legal requirements.
The Terms and Conditions applicable to a booking will normally be those in force at the time the booking is made, except where a change is required for legal, regulatory, health or safety reasons.
The current version of these Terms and Conditions will be available on the Pool 22 website.
19. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in these Terms and Conditions affects any statutory rights that the Customer may have under applicable consumer law.
