Pool 22 – Terms and Conditions

 

1. Definitions

 

‘Pool 22’ refers to Pool 22 Ltd, based at 22 Limes Road, Farnborough, Hampshire, GU14 9TS.

 

‘Customer’ refers to the parent or legal guardian who makes the booking and payment to Pool 22 Ltd. The Customer may also be the accompanying adult who enters the pool with the baby or child.

 

‘Pool 22 – Important Information & Rules’ refers to the separate document of the same name, which forms part of these Terms and Conditions.

 

2. Bookings & Payment

 

All pool hire sessions must be paid in full in advance. Fees are non-refundable and non-transferable, except where explicitly stated in these Terms and Conditions.

 

Bookings are not confirmed until the booking process has been completed and a confirmation email has been issued by Pool 22.

 

Pool 22 reserves the right to refuse or cancel a booking if incorrect or incomplete information is provided.

 

3. Covid-19 Policy

 

In the event that services cannot be provided due to government restrictions or public health guidance, Pool 22 will notify the Customer and propose revised dates and/or times.

 

If the Customer or their child tests positive for Covid-19 and is unable to attend a session, Pool 22 must be informed as soon as possible. Missed sessions due to illness are not refundable.

 

4. Illness & Fitness to Swim

 

Participants must not attend sessions if they or their child are suffering from sickness, diarrhoea, fever, contagious illness, skin infections, conjunctivitis, open wounds, or any condition that may pose a risk to others.

 

Following sickness or diarrhoea, participants must wait a minimum of 48 hours symptom-free before returning to the pool.

 

The Customer must inform Pool 22 in writing prior to the first session of any medical conditions, allergies, disabilities, or additional needs that may affect participation or safety.

 

Pool 22 reserves the right to refuse participation if it is deemed unsafe.

 

5. Swim Nappies & Pool Hygiene

 

All babies and children who are not fully toilet trained must wear a double-layer swim nappy system, consisting of a disposable swim nappy and a neoprene over-nappy.

All customers, except babies, must wear a swim hat (either their own or one provided by Pool 22) and must shower to rinse their body before entering the pool.

In the event of a faecal accident, Pool 22 reserves the right to close the pool for cleaning and sanitisation. No refunds or replacement sessions will be offered in this circumstance.

 

6. Refunds, Cancellations & Missed Sessions

For each paid session, Pool 22 may allow a maximum of one rescheduled session, subject to availability. This does not apply to nationwide restrictions or force majeure events.

Customers wishing to rearrange a session must provide a minimum of 7 days’ notice.

Missed sessions are non-refundable. Where possible, Pool 22 may offer an alternative session, subject to availability, but this is not guaranteed.

Pool 22 may occasionally need to cancel sessions due to unforeseen circumstances. In such cases, Customers will be notified as soon as possible and offered a replacement session.

 

7. Arrival, Punctuality & Departure

Customers should arrive no more than 10 minutes before their scheduled session and must vacate the premises promptly after the session.

Late arrivals may be refused entry if admitting them would disrupt the session or compromise safety. No refunds or time extensions will be provided for late arrival.

 

8. Spectators & Guests

The Customer may bring a maximum of one spectator to observe from the designated spectator area.

The Customer is responsible for ensuring that all guests understand and comply with the Pool 22 Important Information & Rules and remain under supervision at all times while on Pool 22 premises.

 

9. Behaviour & Safeguarding

Pool 22 operates a zero-tolerance policy towards aggressive, abusive, inappropriate, or unsafe behaviour.

Failure to comply with Pool 22 rules or safeguarding standards may result in immediate removal from the premises without refund or replacement session.

 

10. Photography & Video Recording

Customers must notify Pool 22 in advance of the session if they wish to use a camera or smartphone to take photographs or record videos in or around the premises, including underwater recording.

 

11. Health & Safety

The Customer or their nominated adult is responsible for the supervision and safety of their child and any guests while on Pool 22 premises.

All Customers must comply with health and safety instructions provided by Pool 22 staff at all times.

 

12. Private Pool Hire

Where the pool is hired without an instructor present, the Customer accepts full responsibility for the supervision and safety of all participants.

Pool 22 does not provide lifeguard supervision unless explicitly agreed in writing.

An emergency call button is located on the wall opposite the pool ladder and must be used immediately if assistance is required.

In addition, the Customer must call the emergency contact number provided in the booking confirmation email in the event that help is needed.

 

13. Damage to Property

The Customer is responsible for any damage caused to Pool 22 property by themselves, their child, or their guests, beyond normal wear and tear. Pool 22 reserves the right to recover reasonable repair or replacement costs.

 

14. Liability

Pool 22 takes all reasonable care to ensure a safe environment. However, swimming and water-based activities involve inherent risks.

To the fullest extent permitted by law, Pool 22 shall not be liable for any loss, damage, or injury arising from participation in activities at Pool 22, except where such loss, damage, or injury is caused by the negligence of Pool 22.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

Customers participate entirely at their own risk and accept responsibility for their own safety and that of their child and guests.

 

15. Data Protection & GDPR

Pool 22 collects and processes personal data solely for the administration of bookings, communication, and service provision.

Personal data will not be shared with third parties except where necessary for operational purposes or legal obligations.

Customers may request access, amendment, or deletion of their personal data at any time by contacting Pool 22 in writing.

 

16. CCTV

CCTV is in operation on Pool 22 premises for security and safety purposes. Recordings are retained for 30 days before being automatically deleted.

 

17. Force Majeure

Pool 22 shall not be liable for failure or delay in providing services due to events beyond its reasonable control, including but not limited to extreme weather, power failure, equipment breakdown, pandemics, or government action.

 

18. Amendments

Pool 22 reserves the right to amend these Terms and Conditions at any time. The most current version will be made available upon request or via the Pool 22 website.

 

19. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
